[ARCHIVED] Final Decision by HRD on Education and Experience

The Civil Service Commission issued a final decision in the case of Borjeson, et al v. HRD, B2-18-033 – 36, where it ordered that HRD include “acting” time in the scoring of Education & Experience (E&E) for all candidates who passed the November 2017 Fire Lieutenant and Captain promotional exams.  

The Human Resources Division (HRD) is taking the following actions to comply with the Civil Service Commission’s order.

RE:          Borjeson, et al v. HRD, B2-18-033 – 36”

The Civil Service Commission issued a final decision in the case of Borjeson, et al v. HRD, B2-18-033 – 36, where it ordered that HRD include “acting” time in the scoring of Education & Experience (E&E) for all candidates who passed the November 2017 Fire Lieutenant and Captain promotional exams.  

The Human Resources Division (HRD) is taking the following actions to comply with the Civil Service Commission’s order.

Those individuals who obtained a passing score on the exam will receive an email from the Civil Service Unit detailing the Civil Service Commission’s ruling that “acting” time must be accepted and scored as part of the E&E claim on the 2017 Fire Lieutenant and Captain promotional exam administered on November 17, 2017. That email will contain information on how to resubmit their experience claim for the E&E portion of the 2017 Fire Lieutenant and Captain promotional exam a link to a new on-line Experience Claim Application. As with all promotional exams, the information contained on the Employment Verification form must be accurate and validated as true by the Appointing Authority.   Candidates must attach the form to their on-line Experience Claim Application or send it via email to CivilService@mass.gov

The new Experience Claim Application will be available to candidates to submit support of the request for “acting” time.  Only new submitted experience claims will be calculated and added to their originally submitted education claim with their E&E component of the exam.  In the event a candidate does not submit a new experience claim, their original score will remain. New score notices will be emailed to all candidates and after the appeal period, eligible lists will be amended where appropriate and released.  We anticipate the new amended eligible list to be available January 1st, 2019.

Applicants have been provided the following timeline:

On Friday, September 28 an online application titled “2018 Fire Promo Experience Claim for the 2017 Exam” will become available for applicants on Neogov

In order to receive credit for acting time applicants must complete this application

Applicants must attach their new Employment Verification form to the online application or email it to civilservice@mass.gov no later than October 12, 2018. The Employment Verification form must be accurate and validated as true by the Appointing Authority. 

Once all new applications have been received, they will be scored and new score notices will be sent out.  When applicants receive their score notice they will have 17 days to appeal that score to HRD, should they wish to do so.  At the end of the appeal period a new eligible list will be established.  Applicants are not required to submit a new experience claim, and anyone who does not submit a claim will maintain their current score.

As directed in the Commission’s final decision the following situations will not need to be rescored.

  • Current eligible list that contain one employee.
  • In the event your department does not recognize “acting” time, you may submit a letter signed by both the Union and Appointing Authority indicating no member has served in an “acting“ capacity and your candidates do not need to be rescored. Upon receipt of that letter HRD will release the department’s promotional eligible lists.

Hiring may continue off of the current eligible lists, until a new list is established that incorporates the rescoring of the new Experience Application Claim.  Any promotions made prior to January 1, 2019 will not be affected by the Commission’s decision.
